Introduction
Pasokon Labs PLT (“we”, “us”, or “our”) is a limited liability partnership registered in Malaysia and operates Transift. These Terms of Service explain the rules for visiting transift.com or using Transift.
By creating an account, accepting these terms, or using Transift, you agree to these terms. If you do not agree, please do not use the service.
These terms should be read with our Privacy Policy, which explains how we collect, use, and handle information. Nothing in these terms removes any rights or protections you have under applicable law that cannot lawfully be excluded or limited.
Who can use Transift
You must be at least 18 years old and legally able to enter into an agreement to use Transift.
If you use Transift on behalf of a business or another organisation, you confirm that you have authority to agree to these terms for that organisation. In that case, “you” and “your” also refer to that organisation.
You may use Transift for yourself, your business, or clients whose documents you are authorised to process.
What Transift does
Transift converts bank statement PDFs into structured data. It may also perform automated checks, such as checking balance continuity, comparing transaction totals, and identifying possible inconsistencies.
The features available to you depend on your plan and the document being processed. Some formats or documents may not be supported, and some checks may not be available or possible for every document.
We may update Transift to improve its features, reliability, or security. If we materially reduce a paid feature during a period you have already paid for, we will give you reasonable notice and, where appropriate, offer an alternative or a proportionate refund for the affected unused service.
Conversion and validation results
Automated processing can make mistakes. Results may be affected by document quality, missing pages, unusual layouts, incorrect source information, or other limitations.
A successful conversion does not guarantee that every transaction or field has been extracted correctly.
A passed validation check means only that the data met the particular checks performed using the information available. It does not confirm that:
- the document was issued by a bank or is authentic or unaltered;
- all pages, accounts, or transactions have been provided;
- the source document or extracted data is complete or accurate in every respect; or
- the document or transactions are free from fraud or other wrongdoing.
A warning or failed check indicates a possible issue for review. It does not, by itself, establish an error in the original statement, fraud, or wrongdoing. Some checks may be skipped or unable to run where required information is missing or unreadable.
You are responsible for reviewing extracted data and validation results against the original documents before relying on them, sharing them, or importing them into another system. Where needed, you should confirm information with the relevant bank or obtain professional advice.
Transift provides software tools. It does not provide an audit, certification, or financial, investment, accounting, tax, or legal advice. You remain responsible for decisions you make using the results.
These responsibilities do not remove our obligations under these terms or applicable law.
Your account
Please provide accurate account information and keep it up to date.
You are responsible for keeping your password and any access credentials safe, managing access by people you authorise, and their use of your account.
Tell us at [email protected] as soon as you suspect unauthorised access. Change your password immediately if you can.
You must not access another person’s account without permission.
Your documents and information
Your documents and business data remain yours. As between you and us, you also retain the rights in the extracted data and results generated from your documents. We retain ownership of the software and technology used to produce them.
You give us permission to store, copy, process, and transmit your documents and information as reasonably needed to provide Transift, respond to support requests, and otherwise handle information as described in our Privacy Policy. This includes using service providers to help us carry out those activities.
You also give us the right to create and use aggregated or de-identified information that does not identify you, an individual, or your confidential documents or business information, solely to operate, secure, analyse, maintain, and improve Transift and related services and to understand their usage and performance.
You are responsible for making sure that:
- you have the rights, permissions, and other lawful authority needed to upload and process the documents;
- your use of Transift complies with applicable law and any duties you owe to clients or other people; and
- you provide any notices and obtain any permissions required when sharing information about other people.
Please keep your own copies of source documents and any results you need. Transift is not intended to be your only document archive or backup.
Privacy and confidentiality
We handle personal information as described in our Privacy Policy, including information about service providers, international transfers, security, retention, and deletion.
We treat your non-public documents and financial information as confidential. We will use and disclose them only as permitted by these terms and our Privacy Policy, as you authorise, or as permitted or required by law.
We take reasonable steps to ensure that people and providers who access confidential information on our behalf are subject to appropriate confidentiality obligations.
These confidentiality obligations do not apply to information that becomes public without a breach of our obligations, that we lawfully receive without a confidentiality restriction, or that we independently develop without using your confidential information.
Acceptable use
You must not:
- use Transift for unlawful, fraudulent, or misleading activities;
- upload documents or information you are not authorised to share;
- use the service to infringe another person’s privacy, confidentiality, or intellectual property rights;
- introduce malicious software or interfere with the service or its security;
- try to access accounts, documents, or systems without permission;
- bypass payment requirements, usage limits, or access controls;
- copy, reverse engineer, or attempt to obtain the source code of Transift, except where applicable law permits this; or
- resell access to Transift or present the service as your own without our written agreement.
These restrictions do not prevent you from using Transift to provide authorised services to your clients or sharing the results with them.
If we provide an API or another automated access method, you must follow its published usage limits and instructions.
Plans and payments
Some features require payment. The price, currency, billing period, usage allowance, and any applicable taxes will be shown before you purchase.
You agree to pay the charges for the plan or service you select. Additional usage charges must be disclosed before you agree to incur them.
If a plan uses pages, documents, conversions, or credits to measure usage, the applicable counting rules and any expiry or rollover conditions will be shown in the plan details or at purchase.
Stripe is our current payment-processing provider. Stripe handles payment details under its own terms and privacy policy. Transift does not store payment credentials.
If a payment fails or becomes overdue, we may ask you to update your payment details and may suspend paid features after giving reasonable notice.
Subscriptions, cancellation, and refunds
If you purchase a recurring subscription, it renews for the billing period shown at purchase unless you cancel before renewal. You authorise recurring charges for that subscription.
You can cancel using the account controls provided or contact us through Transift if you need help. Cancellation takes effect at the end of your current paid period unless we tell you otherwise, and you can normally continue using the paid service until then.
Unless stated at purchase or required by law, payments are non-refundable for a change of mind, unused allowances, or cancellation partway through a billing period.
If we cannot provide a paid service or it does not meet a requirement that applies under law, this refund provision does not limit any remedy you are entitled to receive.
We may change prices for future purchases or renewals. For an existing subscription, we will give reasonable notice before a price increase takes effect so you can cancel before the next charge.
Any free-trial period and whether it converts to a paid subscription will be explained when you sign up.
Availability and third-party services
We use reasonable care and skill to provide Transift, but we cannot promise that it will always be available, uninterrupted, or free from errors.
The service may be unavailable because of maintenance, updates, technical problems, or events outside our reasonable control. We will take reasonable steps to address problems affecting the service.
Transift may allow you to export data to or use it with third-party services. Your use of those services is subject to their own terms. You are responsible for checking the results after an export or import.
This does not remove our responsibility for service providers we engage to carry out our own obligations.
Our intellectual property
We or our licensors own Transift, including its software, design, branding, and underlying technology.
While you comply with these terms, we allow you to use the service within your plan’s limits. This does not transfer ownership of Transift or grant permission to use our name or branding in a way that suggests our endorsement.
If you send us suggestions or feedback, we may use them to improve Transift without paying you. This does not give us ownership of your documents or confidential business information.
Suspension and ending access
You may stop using Transift at any time. If you have a paid subscription, you should also cancel it to stop future renewals.
We may suspend or end access if you seriously or repeatedly breach these terms, fail to pay amounts due, create a security risk, or use the service unlawfully. We may also do so where required by law.
Where reasonably possible, we will explain the reason and give you an opportunity to resolve the issue. We may act immediately if needed to protect the service or other people, prevent misuse, or comply with law.
If we discontinue the service or end your paid access for reasons unrelated to your breach, we will give reasonable notice and refund any prepaid fees for the unused period or service.
When access ends, your right to use Transift ends. Where reasonably possible and lawful, we will give you an opportunity to export your documents and results before access is removed. We cannot guarantee continued access after account closure.
We retain or delete information as described in our Privacy Policy. Ending your account does not necessarily result in immediate deletion of all records.
Any provisions that reasonably need to continue after access ends, including confidentiality, payment obligations already incurred, intellectual property, liability limits, and dispute provisions, will continue to apply.
Service warranties
Except for the commitments expressly made in these terms and any rights required by law, Transift is provided on an “as is” and “as available” basis.
To the extent permitted by law, we do not give additional warranties that the service or its results will be complete, accurate, suitable for a particular purpose, or meet every requirement you may have.
Nothing in this section excludes any guarantee, warranty, or remedy that cannot lawfully be excluded.
Customer indemnity
You will defend, indemnify, and hold harmless Pasokon Labs PLT, its affiliates, and their respective officers, directors, employees, contractors, service providers, and representatives from and against any third-party claims, losses, liabilities, damages, costs, and reasonable legal fees arising out of or relating to:
- information uploaded, submitted, or processed by you or an authorised user through Transift;
- your or an authorised user’s unlawful use of Transift;
- your or an authorised user’s breach of any intellectual property, privacy, confidentiality, or other person’s rights; or
- your or an authorised user’s breach of these terms.
This obligation does not apply to a claim to the extent caused by our breach of these terms, negligence, or wilful misconduct.
We will give you prompt notice of an indemnified claim and provide reasonable cooperation in its defence at your expense. You will control the defence and settlement of the claim, but may not settle it without our prior written consent if the settlement admits our liability, imposes an obligation on us, or requires us to make a payment or take any action. We may participate in the defence with counsel of our choice at our own expense.
Limitation of liability
To the extent permitted by law, we will not be liable for:
- loss of profit, revenue, business opportunities, or anticipated savings;
- loss of goodwill or reputation; or
- indirect, consequential, special, incidental, exemplary, or punitive loss or damage;
- loss of, corruption of, or damage to documents or data;
- the cost of obtaining substitute goods, services, software, or technology; or
- loss or damage caused by malware, viruses, or other harmful code, except to the extent directly caused by our fraud, wilful misconduct, or negligence.
Subject to the exceptions below, our total combined liability arising out of or relating to Transift or these terms is limited to the greater of:
- the total fees you paid us for Transift in the 3 months immediately before the event first giving rise to the claim; or
- RM100.
This is a combined limit for all claims, rather than a separate limit for each claim. It applies whether a claim is based on contract, negligence, breach of a legal duty, or another legal basis, to the extent permitted by law.
The exclusions and limits in this section do not apply to fraud or wilful misconduct by us, death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded or limited.
Nothing in these terms limits any rights or remedies you have under applicable consumer-protection, privacy, or other laws where those rights or remedies cannot lawfully be excluded or limited.
Events outside our control
We will not be responsible for a failure or delay caused by events outside our reasonable control, such as natural disasters, widespread internet outages, or government restrictions, to the extent permitted by law.
We will take reasonable steps to reduce the effect of the disruption and resume the affected service. This does not remove any refund or other rights you have under these terms or applicable law.
Malaysian law and disputes
These terms are governed by the laws of Malaysia.
If you have a dispute with us, please contact us first so we can try to resolve it. This does not prevent either party from seeking urgent relief or exercising rights within any applicable time limit.
Subject to any mandatory rights you have to bring a claim elsewhere or before a relevant tribunal, disputes relating to these terms or Transift will be dealt with by the courts of Malaysia.
Changes to these terms
We may update these terms from time to time. The latest version will be posted at /terms, with a new last-updated date and, where different, an effective date.
If we make an important change, we will give you reasonable advance notice by email or another appropriate method, unless an earlier change is needed for legal or security reasons.
If you do not agree to an updated version, you may stop using Transift and cancel your subscription before the change takes effect. Changes will not apply retrospectively to disputes that have already arisen.
Where applicable law requires notice or consent for a change, we will provide that notice or obtain that consent rather than relying only on continued use of Transift.
Other terms
These terms, the plan details you accept at purchase, and any separate written agreement with us form the agreement for your use of Transift. If a separate written agreement expressly changes these terms, that agreement takes priority for the matters it covers.
You may not assign or transfer these terms, or any rights or obligations under them, without our prior written consent. We may assign or transfer these terms, in whole or in part, in connection with a merger, restructuring, reorganisation, sale of all or part of our business or assets, or a similar transaction, provided that this does not materially reduce your rights under these terms.
If a provision is found to be unenforceable, the remaining provisions will continue to apply to the extent possible.
If we do not immediately enforce a provision, that does not mean we give up the right to enforce it later.
